Houston Office Wins Unanimous Defense Verdict in Texas Jury Trial

On April 7, 2006, Abbott, Simses & Kuchler shareholders, Richard Simses and Jon Vicklund, of the Houston office, obtained a defense verdict on behalf of a global leader of turnkey blending and transfer systems for the process industries after a six day jury trial in the 55th Judicial District Court in Harris County, Texas. 

In that matter, the Plaintiff sued the Firm's client alleging that the Plaintiff entered into an oral partnership / joint venture with the client relating to the supply of online gasoline batch blending optimization software for an oil refinery in Constanza, Romania. The Plaintiff asserted claims at trial for breach of partnership, breach of fiduciary duty, negligent misrepresentation, unjust enrichment, and fraud.  The Plaintiff claimed lost profits in the amount of $600,000.00. 

The fraud issue was presented to a jury, who returned a unanimous (12 – 0) verdict in favor of the Firm's client, thereby exonerating the Firm's client from any fraud allegedly committed against Plaintiff.
