Houston Office Obtains Wrongful Death Defense Verdict in Texas Jury Trial

On May 4, 2006, Abbott, Simses & Kuchler shareholders, Richard Simses and Charles Miers, of the Houston office, obtained a defense verdict on behalf of a major oil and gas company in a wrongful death case after an eight day jury trial in the 127th Judicial District Court in Harris County, Texas. 

In that matter, the Firm's client purchased an out-of-service salvage oil and gas platform and contracted with a company to refurbish the platform. During the restoration of the platform, the company's employee fell to his death when he stepped on a piece of loose gravel prior to securing himself to a safety harness. 

The decedent's parents brought claims of negligence and strict liability against our client as a result of this industrial accident.

The Firm tried this case to a jury in 2003, but after three days of deliberation, the court declared a mistrial when the jury was unable to reach a verdict. In this retrial, the jury returned a verdict in favor of the Firm's client after approximately one hour of deliberation finding that decedent's employer and decedent were at fault for the unfortunate accident.
