The Louisiana Second Circuit Court of Appeal recently affirmed the dismissal of Abbott, Simses & Kuchler's client, Tyco International Ltd., from a case involving allegations of business fraud. Attorneys Larry Abbott, Amy Maccherone and André Maillho, successfully defended Tyco in this matter involving a long-standing dispute between the plaintiff and his purported business partners over the development of medical technology. Plaintiff claimed that Tyco’s 1998 acquisition of a company effectively deprived him of his alleged interest in that technology. In August 2007, the Fourth Judicial District Court for the Parish of Ouachita granted Tyco’s Exceptions of No Cause of Action and Prescription and dismissed Tyco from the case. In affirming the trial court’s decision, the Second Circuit held that plaintiff failed to plead any facts that could support a cause of action for fraud, conspiracy or conversion against Tyco.
