On March 31, 2006, Abbott, Simses & Kuchler attorneys, Charles Abbott, Amy Maccherone, and Gregory Aycock, of the New Orleans office, successfully obtained a significant Motion for Summary Judgment on behalf of a Fortune 100 company. This matter involved the asbestos-related injury claims of a plaintiff, who died as a result of mesothelioma. In this case, two defendants filed third-party demands against the Firm's client. They alleged that in the event of a judgment against either defendant in the principle demand, the Firm's client was liable unto them for legal indemnity and/or contribution. The Court granted the Firm's Motion for Summary Judgment agreeing that the third-party plaintiffs did not satisfy their burden of proof as to causation of plaintiff's injuries. The case against the Firm's client was dismissed with prejudice. The Court's Judgment in favor of the Firm's client was returned by the Civil District Court for the Parish of Orleans. |
