Abbott, Simses & Kuchler Successfully Obtains Judgment In Indemnity Action Against One Of The World’s Largest Oil Companies

Charles Miers and Bruce Evanick recently obtained a favorable judgment on behalf of an international life science company in an indemnity action against one of the world's largest oil companies. The oil company had steadfastly refused to indemnify our client despite its contractual obligation to do so.

Abbott, Simses & Kuchler pursued an indemnity action against the oil company for breach of the indemnity agreement, seeking defense costs and settlement funds expended in the underlying litigation, as well as defense costs incurred in prosecuting the case. Both parties moved for summary judgment on the indemnity agreement, and the Court of Appeals for the First District of Texas reversed the trial court and rendered judgment in our client’s favor. The Court of Appeals awarded our client the exact amount of damages it was seeking, approximately $750,000.00 in damages.
