Abbott, Simses & Kuchler attorneys, Deborah Kuchler, Darren Guillot and Rhea Sheldon successfully obtained a significant Motion for Summary Judgment on behalf of a Fortune 100 company in the United States District Court for the Southern District of Mississippi. This matter involved alleged benzene-related injury claims of a plaintiff diagnosed with acute myelogenous leukemia. Plaintiff claimed that her leukemia was caused by exposure to benzene in gasoline associated with her work as a cashier at various convenience stores. The Court granted our client’s Motion for Summary Judgment, agreeing that plaintiff did not satisfy her burden of proof as to liability under the Mississippi Products Liability Act. The case against our client was dismissed with prejudice by the Court. |
