The Jackson, Mississippi office of Abbott Simses prevailed on a Motion to Dismiss filed on behalf of three of the Firm's clients.
Plaintiff, who was diagnosed with non-Hodgkin's lymphoma (“NHL”), sued sixty-five defendants that allegedly manufactured benzene and benzene-containing products found in paints and oil products. Plaintiff claimed that his NHL was caused by exposure to these products.
The Firm argued that the plaintiff failed to comply with the Court's order requiring the plaintiff to file an amended complaint detailing specific information relating to the plaintiff's alleged injuries and exposure.
The Circuit Court of Choctaw County, Mississippi agreed with the defense argument and granted the Motion to Dismiss. The Court also noted that the plaintiff failed to satisfy Mississippi pleading requirements. Consequently, the Court dismissed the Firm’s clients with prejudice pursuant to Mississippi Rule of Civil Procedure 41(b).
