Recently, Rhea Sheldon, of the Jackson, Mississippi office of Abbott, Simses & Kuchler, successfully obtained a significant Motion to Dismiss on behalf of three of the Firm's clients. This matter involved the benzene-related injury claims of a plaintiff, who was diagnosed with non-Hodgkin's lymphoma. In this case, plaintiff sued sixty-five defendants for allegedly manufacturing benzene and benzene-containing products found in paints and oil products. The Firm argued in its Motion to Dismiss that the plaintiff failed to comply with the court's order requiring the plaintiff to file an amended complaint detailing specific information relating to the details of that plaintiff's alleged injuries. The Circuit Court of Choctaw County, Mississippi granted the Firm's clients' Motion to Dismiss, agreeing that the plaintiff did not comply with the Court's order to detail specific information relating to the details surrounding the plaintiff's alleged injuries. The Court also noted that the plaintiff failed to satisfy Mississippi pleading requirements. Consequently, the Court dismissed the Firm’s clients with prejudice pursuant to Mississippi Rule of Civil Procedure 41(b). Rhea Sheldon is an Associate in the Jackson, Mississippi office.
