Abbott, Simses & Kuchler achieved a significant victory representing a Fortune 500 company in a class action suit. Monique Weiner of the Covington office, and Janika Polk of the New Orleans office, co-tried this matter in the 40th Judicial District Court of Louisiana, Parish of St. John the Baptist. The case arose from a release of paint waste fumes from a rotary kiln incinerator. Neighbors of the Client’s plant filed suit claiming that they had sustained various injuries as a result of the release. The Client stipulated to liability, and the case was tried on the issues of causation and damages. Following the bench trial, Judge Madeline Jasmine ruled in the Client’s favor, holding that plaintiffs failed to meet their burden of proof that the release caused any injury to plaintiffs. The judge also noted in her written opinion that the expert testimony presented on behalf of the Client was unrefuted by plaintiffs. |
